You'd better be sure before you make a move.
If it was indeed cashed, scan the cashed check and send the scan to the guy indicating that you would take legal action. That type of evidence should hold up in court.

There are frauds out there, but don't sink to their level! Be stern, but always use a professional tone in all your e-mails and phone calls. That way, it will always be very clear to others who is at fault. Plus, use the tools that eBay provides to deal with these matters including reporting the seller and providing negative feedback, etc. By the way, looking at the big picture, $17 is a pretty small hit to take considering the amount of cards that pass through your hands. Just my thoughts. -Bob
