I just purchased a cell phone to bridge the gap to get me to my next upgrade (current one is one its last figurative legs). Well the seller shipped it priority in a small flat rate box, and when I received it there was only a package of Christmas greeting cards. The seller has been very cooperative, and the box looks like it has been played with and possibly reopened. The seller used priority shipping (shipped out Oct 21 and arrived Oct 25, kind of slow for Priority), so I have a DC, but no insurance was used.

Do I have any chance of making this situation ok, so the seller and myself aren't screwed out of our money and merchandise?

Well the seller is in contact with me, so its not an issue of this being the sellers fault. This is the USPS possibly stealing my item then replacing it during transit.

I can for sure tell you that if it was someone at the post office they will take no responsibility whats so ever for it!!! They will tell you this, "without insurance there is nothing we can do"! Same thing they say when they lose packages! So its almost a waste of time trying to hagel with them! Someone will take a loss here, ether you or the seller! And paypal will rule in you favor, so he will be out the money. Its sad but thats how it always will end in a case like this where the PO is a fault.

-2001-2006 topps tix super tix superbowl ticket stub cards and auto version.
-Colts Super Bowl tickets from any Super Bowl they played in. Prefer full tickets but would be open to stubs as well. Only tickets from the Manning ERA!
-A Super Bowl ticket or stub from the AZ Cardinals and Steelers.
-Any full ticket or stub that has Edgerrin James on it!
-Edgerrin James- Mostly rarer stuff. Also odd ball type items.
-Javarris James- Mostly rarer stuff. Also odd ball type items.
-Any checklist that has Edgerrin or Javarris James name on it!
-Any cards of the actors from Married With Children.
-Ice-T auto- From Razor.
-Some of the Celebrity GU and autos. Mostly famous movie actors I like. Nothing super high end.

Well the seller has opened a claim with the USPS, and I am going to turn in the contents to my local usps for possible investigation. The seller said he would send me another phone for the trouble. I actually look forward to working with the seller because he is being very cooperative. He said he packaged the phone with clear tape, and then I received it with priority tape all over it.
